You don't go to jail if you do it. Therefore it is not illegal.

Based solely on private servers and not other MMO's its simple. It's called economics. If people want to sell, they will sell below the list price (although looking at the intellect of some people on this server, it wouldn't surprise me if they bought items for MORE than the list price -.-) in the theory that that will cause people to buy from them. Which means gamez is now competing against its own players for money. And not to mention that there will be tons of people who abuse the system which will just cause more issues for gamez. The server is, up to an extent, much more reliable due to the necessity of keeping face than say a random user. It will also cripple in game trade as people will be more akin to sell for real money versus in game items.

Allowing RMT has no benefits either, its just a long list of cons. It makes no sense to me to allow it, and especially not in a fiscal sense.

Illegal means something that breaks rules, not something that gets you sent to jail. -.-

But rule-breaking isn't quite on the same level as illegal imo.

There is a thing we call as E-Commerce law which prohibits selling or taking profit of virtual items/goods you do not own. Have you ever wondered why Private Servers sells items(masking) in the form of Donation instead of selling credits directly like what Legal Publishers(NCSoft, Codemasters, LUG, etc.etc.) do. That is because private servers may get in trouble with the authorities for taking profit without paying or having legal transaction to the real owner/amker of the games. Same with the virtual items, we own the characters and items but we don't own the virtual rights of the items to sell it and earn profits (cash) from it (the virtual rights belongs to the game makers/developers).
